would you be interested in spending some time everyday for IV volunteer work?
If yes, update your profile with contact information for us and let us know your interest area for IV work and we can work together. Posting a note on the forum can only help you and the organization if an effort is made to solve the problem.
Work with us. Join state chapter and meet lawmakers and tell them about your issues. Our combined energies can be utilized here and we can make a difference.

The process of converting of the American society into a Latino-Mexican one is well on its way and progresses.
This and many other threads have undoubtedly a huge racist component and we urge the administrators to quickly remove them.
You don't deserve to get a green card!
What is the difference between that anti-mexican speech and Sensenbrener's & Tancredo's theories?:(
We could say" We are not going to worship cows and take ritual baths in dirty rivers..."
Shame on you!

Yes, but the immigration hearings already happened. People already have a clear indication on what the public wants. Lou Dobbs is still out there reminding them. Honestly, I wish us good luck, but I am not sure.
Seems like you are indicating that public clearly against CIR: on what basis you are saying that. There was no referendum and even an election after the CIR debate. Most of the opinion polls are evenly split: if I remember correctly a popular opinion poll said that most Americans want to solve the immigration issue and they also are fine with putting illegal immigrants on path to citizenship. They also want to have more border security provisions most of these aspects are covered in CIR. Of course illegal immigration issue is controversial and CIR may never succeed in its current form irrespective of who is in control of congress. A democrat leading congress may not venture into too controversial aspects of immigration fearing a backlash during presidential elections. The backlash they fear is energizing the extreme right wing. A republican leading congress anyway wont pass CIR bill.
Thats why our best bet is SKILL bill this is relatively non-controversial, good for American industry, and supported by different groups. Of course it is very difficult.
Not sure if such an important bill will be taken up during lame-duck session. In fact the outgoing house members may actually push for some aggressive border security measures to make the process even longer than it is now. So yes.I too wish us good luck we do need it a lot.

If Microsoft with all the money and power can't get visa increase, it's naive to assume that we can do that in one shot. Let's just fry the small fish first.
Well said actually!
From the past couple of years and efforts it is VERY clear that any kind of Quota Increase is a BIG no no with the Anti-immigrants. This now divides the IV users into 3 groups
1) This group has already applied for the I-485 a Long time ago but has not seen their GC in the mail yet.
2) This group has not been able to file for I-485 coz of retrogression.
3) This group is stuck in Labour Certification stage and cant do anything about it.
How about for starters if we try and alleviate the pain of people in groups 2 and 3, i.e. ask for people to be able to apply for stage 3 (and ead etc) without the PD mess. For the labour people we ask for a similar benefit. As for group one, well i know that you guys do not benefit under this, but consider this, you are already in a much better situation than the rest of 2 groups. I know you have to go for fingerprinting etc and renew the EAD every year, but consider this: People stuck in LC and stage 2 have to spend much more on renewing H1/H4s coz of lawyer fees. Maybe, if we reduced our demands to asking for 3 things
a) Filing for stage 3 regardless of PD
b) Relief for people in the LC mess
c) Fingerprinting one person just Once (i mean fingerprints dont change do they?)
This might go under the radar as no quota increase is being asked for. I know this point has been discussed ad-infinitum before and we concluded that no more band-aids for the immigration process, let us get a permanent solution. Well permanent solutions take their time, especially with a Much more powerful lobby opposing those changes. For all we know this permanent solution may NEVER go through. Lets face the facts here:
1) The big corps are pushing ONLY for H1B increase.
2) Anti-immigrants are opposed to ANY kind of increase in numbers.
3) Currently the political climate is such that it is either, deal with legals AND illegals or nothing at all.
4) Currently FAR bigger problems stand in front of the lawmakers such as the war, stem cell, abortion etc etc etc.
5) Currently the average American is OPPOSED to even legal immigrants for fear of losing their jobs to them.
In light of all this, does it make sense to go for a Comprehensive Permanent solution or does it make sense to ask for smaller tid-bits and treat the other costs we incur as "costs of doing business"? I mean atleast if the husband and wife Both have H1bs and jobs, you will still be making a ton of money. U use things like approved I-140s to switch jobs with 3 year extensions or u use the EADs. Let us seriously think about this solution.

Well, my old carcass is getting too aged to handle that anymore. So now I ease off the sauce and go to the gym.
But I do also try to notice and enjoy the silliness of the every day human condition. (Still to this day, I'm not sure why I mow my lawn, for instance.) A sense of humour is very important. Recognition that there are others less fortunate. And stay connected with friends socially.
And also recognize that fact that a green card won't make me magically happier beyond the immediate jubilation. Yes it is good to regain the rights we lost coming to the US. To speeches I'll still smile, nod, even clap and think "what a bunch of nonsense!" for privacy is the true freedom that you still have. But I'll still work for a living. I'll still put on a dress shirt to impress clients I'll never see. I'll still try to spend more time creating than managing. Not simply because my h1b legally requires me to do so, but because managing is intellectually trivial. Or one could say that managing is the work of man, creation is the work of the gods. ; )
Chin up!

Could you please show us, where in the link you provided, H-1B applicant needs to treated equally for job hiring as compared to GC and EAD workers.
EOE deals with equality (i.e. equal opportunities) for hiring, job promotion, and firing.
IRC Act 1985 deals with unlawful employment of aliens, unfair immigration-related employment practices, and fraud & misuse of certain immigration-related documents.
Two different things.
However, once H-1B applicant is hired, he/she is protected just like any other worker, for job promotions, training, and other work conditions. But employer is under no obligation to extend H-1B beyond any initial H-1B petition date. And, yes, H-1B can also be fired at will*, just like any other worker.

desi3933,
Here is the part of the law that says a job aspirant should not be discriminated by his/her immigration status as long as he/she has a valid work permit( H1B/GC/EAD/Citizenship).
"(1) GENERAL RULE. -- It is an unfair immigration-related employment practice for a person or other entity to discriminate against any individual (other than an unauthorized alien) with respect to the hiring, or recruitment or referral for a fee, of the individual for employment or the discharging of the individual from employment --
The only individual that can be discriminated against is an unauthorized alien. H1B/GC/EAD/Citizen does not fall in this category.
Walking dude's effort will at least highlight the fact that H1Bs are not preferred over GCs/Citizens. In fact it is the other way around. One of my colleague who recently got his GC, was surprised to see so many job offers opening up for him just because he was a GC hoder.

record conversatios with these jack ass employers. It is surprising how much crap and illegal things they tell and do during negotiations. Not sure about the legality, would not harm if you dont use it. We keep seeing news on people getting screwed and then when outed the victim is not usually screwed by the system again.
Also, I wonder if any employment contract not tied to any reasonable time estimate( like 485 - who knows when we will get it) will hold. Its akin to slavery.

Section 205. Retaining Workers Subject to Green Card Backlog.
This section specifies anyone caught in the backlog would be able to pay $500 to adjust status... So your husband is ok (again, should this SKIL ever become reality)
However, I am confused this section 205 falls into Title II, "Retaining Foreign Workers Educated in the United States". Section 205 does not read like anything to do with a degree in the US..
wow,
what do you say, ordinary folks in EB3, without US Masters will not be able to proceed toward I-485 stage when visa is unavailable?
Hmmm, I will have my Masters, but I cannot work, as I cannot get h1 because of the 6th year limit (just like so many h4's). My hubby does not have US Masters, so he will wait in EB3 forever?
Can I slap my Masters to his name so he can proceed faster and I can finally get my EAD..?

We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that dont have our finger prints in file. I never got any notice and my lawyer said they dont need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 15 business days more. Our current EAD were expiring soon and I called congresswomans office next day. Got the approval email yesterday evening. Dont know what worked. But what a huge relief.
EB-3-India (March 2003)
Labor Approved: Oct 2006
I-140 approved Jan 2007
I-485 applied June 2007
EAD (Renewal) applied May first week 2008
Called USCIS and Opened SR August first week
Infopass at local uscis office: Aug 20th
Called Congress Womans office: Aug 21 st
EAD Approval email: Aug 25
Does this mean, if someone has never done FP for 485, will need to do it now for EAD even if it is paper based?

I just visited last month. I stayed there for 6 weeks...
Agree that economy is booking but....
(1) too much pollution.
(2) No infrastructure to handle cars and two wheeleers.
(3) too much mosquito even in winter/summer. I do not know what will happen in rainy days.
(4) prices for every item have gone up by 3X..Most of the item I am not able to justify the rise. The quality of the product has not gone up.
(5) easy to set up business..get house...get car but tough to drive peacefully...need to pray god every morning so that we come back home with 2 hands and 2 legs and unbroken body parts.
(6) Club culture is booming too...so if you have daughter who is teen then need to check by that angle too.
Just my two cents....
@ asdcrajnet - All the very best to you !! May you have a great life back home !!
@Thakkar
I agree there are many issues we have back home but after all it is our country -:)
there is something that pulls me back to and we are also thinking we will go back in the next couple of years. It will not be easy as we love this country too...but then one of the main reasons we are going back is the way is the culture here... I am not very comfortable with the culture here and would like my kids to have the Indian culture...I agree there is a lot of westernization back home too...but I guess there is some hope there still to have a little control on the kids...or help them go the right way...here I am not saying it is wrong...but is a totally different culture....which is what I am not able to digest....
Also, we are alone here no family or extended family and that too is not easy (I think)
Lack of social support....
I respect this country a lot and love this country (and my country too -:) ...I am what I am today because of India and US.
If we end up going (I am sure at some point we will), we will always be greatful to America !!!

unfortunately more than 80% of backlog elemination is completed, so labor substitution even though it is removed from july 16 has already done its damage. scores of people have already done labor substitution.
How come they did not stop the substitution right away? Instead, giving it another month. Wish they gave the visa bulletin another month.
