    This may sound optimistic and promising, but in essence sending random rhetoric using off message statements like "Erase Backlog Now" conflicts with our targeted messaging. To the observer on the Hill (i.e. in Congress) it all sounds more like a noise without a coherent message.

    I'm sure you would agree that "no harm in trying" and "Leave no stone unturned" doesn't mean diluting our effort or sending incoherent message. That is why we need to have a single voice sending the same targeted message each time, otherwise we will just sound like awkward noise.

    From all the options we have at hand immediately, I suggest the following to be the quickest and most effective

    Chant the mantra "Man Yo Ho Rehna Kyo"
    This should be done as many times as possible for 2 weeks
    Avoid chanting from 12:00-3:00
    Keep in mind the person who you think is the obstacle on your path while chanting

    It worked for someone I know. It worked for me. And now to make it work for all of us we all have to chant. Remember, just 2 weeks!

    in one of the threads its said that all 90 senators had agreed to pass the SKIL as against one who did not (sen sessions) and since lame duck required unanimous voting it cud not, but when the demo's bring it up early next year, they would not need an unanimous vote on it but a majority vote? so statistically it sud get through? how far off am i on this?

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    Switch to EAD...and stop worrying about GC

    Called two weeks ago as per my post above. No FP yet. At this point I don't even care anymore... :(

    Thats a good way to lead the life, but this immigration process is taking a big toll . Hope we all come out of this

    My I-140 has approved by NSC in Apr 2006. Now I'm moved to Houston.
    Now I have applied my I-485 from Houston. My lawyer send my application to NSC. Since my current residence is in TSC region my application will be transfer to TSC. So I don't know how long it will take to get the receipt#.
    My application received on 07/02/2007 at NSC.

    I agree: you should take legal advice from as many attorneys as possible. In my experience with multiple attorneys on these topics (i.e., self-employed vs. W2 on EAD, and "filing" AC21), I got conflicting pieces of advice. So the only resources I could base my thinking on are USCIS and IRS.

    I strongly dispute that. I encourage you to consult an attorney before taking any action.

    AC-21 job must be "permanent and full-time" just like I-140. Simple. Infact, please put your question in attorney forum and get it confirmed right there.

    I did answer your question about non-retrogressed countries earlier. there will not be a lot of diffrence for them. example: germany ebdependent (1,2,3) moving from ebquota to germany fb2a. both are current now.

    I have answered this in another post. The impact will be minimul. I expect them to wait 7 years in place of 6 years now. again the primary can become citizen quickly and move them from FB2A -> FB1. That doesnt mean they are affected, wont they have no strings attached EAD/AP ?

    Ok, I am still trying to figure out what you said about non retrogressed countries/EB1. A person in EB1 files for labor and gets approved in a year. Suppose he has a priority date of 08, his dependents will have to wait for at least 4 years according to the current bulletin for Family 2A. Am I missing something here?

    The culprit being subjected to Gandhigiri (Gandhi-ism: A strategy to win unjust,corrupt mind by highly unexpected pleasant deeds.)has some shame and self respect.If the target is a moron, he would slap you to death, no matter how many chances you give him.

    In our case we don't even know who the culprit is (USCIS/DOS/Capitol Hill/Anti-Immigrants/Lobbyists). The only thing that would come out of these flowers is a security alarm. I know many would take this as a negative approach, but this is the most logical outcome of this deed.

    On a lighter note, if sending flowers/fruits would have won hearts of the immigration officers, imagine how easy GC would be for those illegal immigrants who work in the farms.

    For all those bouquets your sending... they will dismiss it as some security breach... cmon dont u know by now how USCIS is after 9-11.

    They might just create panic out of innocent lovely flowers.

    "EB-2 India. This category is expected to remain unchanged or to move very slowly forward (by a week or so) in the short-term. This is mainly caused by the fact that many EB-3 India applicants (there are approximately 60,000 EB-3 India pending cases) are �porting� their priority dates into the EB-2 India category and are thus taking visa numbers.


    EB2 India is slowwly becoming EB3 as thousands are porting from EB3 to EB2. Some of them are really worthy of EB2 and some of them are fradulent.

    EB2 India applicants should wake up from their celebratio of a few months leap and get ready for slow movement or retro.

    Guys wake up and fight to make the porting rules veryu strong if not stop porting. The rule should be if I140 for porting is denied then the applicatnt should loose his/her initial EB3 priority date also as he /she has indicated that he/she is no longer working in the position as described in EB3 labor. This will make sure that fradulent applicants cannot port from EB3 to EB2.

    P.S: I know I will get thousands of REDs. I do not care... EB2 I guys wake up.. Time is running out.. EB2 I will very quickly become same as EB3I.

    Better do not write and waste someone time. Probably you may loose your GC too if you are not united.

    Try to support EB's, not EB2 or EB3. People wait for 10years to get the GC in EB3, They are well qualified and Experienced.

    I tend to disagree from you on your comment regarding a possible link between name check and FP. I think they are seperate processes and run in parallel - one does not depend on another. I've read somewhere that a guy's name check was initiated like a month before he went for his FP. He got that info from infopass appointment. Also, wouldn't the IOs mention about the pending name check if it was related to FP notice?

    Regarding reaching a non TSC IO, I think is impossible since the call gets directed to TSC or NSC based on the receipt number that you key in when you call.

    I agree with you that we'll end up getting the same damn letter as our friend about no appointment availabality at local ASC for our SR response. It seems to me that we have to try either the Infopass or just wait it out.

    Has anyone thought about writing to ombdusman (if I spelled it correctly) about this FP notice issue or will that be not worth it?
